Vito Fossella: Vito Fossella sentenced for drink driving

Vito Fossella has been sentenced to 5 days in prison for drink driving. Vito Fossella’s lawyers said they are immediately appealing his sentence.

Vito Fossella was arrested on May 1 2008. Fossella was in a Virginia suburb of Washington. Under Virginia’s law, a drunk driver who registers a blood alcohol level of 0.15 or more must serve 5 days in prison. Police said Fossella’s blood alcohol content had been 0.17.

Fossella’s lawyers tried to delay sentencing by asking the court to wait for the arrival of a toxicology expert. One of Fossella’s lawyers said the breath analyzer used on Vito Fossella was faulty and the reading was not accurate. The judge rejected the claims. Vito Fossella was sentenced. He is supposed to start his sentence on Dec. 19.
