By Therese Lisieux on January 1st, 2009Oscar Grant, 22, was fatally shot on the platform of Fruitvale Station. BART officers reported an altercation on a Dublin/Pleasanton bound train. BART Police responded.
The authorities did not relate how the officer’s firearm was discharged. Witnesses told the press that Grant was on the ground and handcuffed when he was shot. BART police have started internal and criminal investigations on this fatal shooting.

The “OAKLAND video” is a different video of the BART shooting taken by an unidentified cell phone user who wants to remain anonymous. This video has a clear view of the BART shooting . It showed Grant restrained by one officer while a second officer drew his gun from his holster and shot Grant in his back. Oscar Grant’s friend, Fernando Anicete, was nearby when this happened. Anicete said he could not understand why Grant was shot when he was obeying orders.
John Burris, lawyer for Oscar Grant’s family, has seen the cell phone video of the BART shooting. Burris said the Grant family will sue for $25 million. Burris will ask the city’s D.A. to file a lawsuit on the BART officer who discharged his weapon.
There are questions on whether race played a factor in the shooting.

Johannes Mehserle, 27, BART police veteran of 2 years, was the officer who shot Oscar Grant. BART did not release the name of their officer but the newspaper, The Chronicle, found out. Mehserle has just become a new father as his baby was born one or two days after the shooting. The report assumed that was the reason why he has not made his statement yet.
