Maria Besedina: Maria Besedina lost lawsuit against MTA

Maria Besedina, 25, was sexually assaulted in a New York Subway on June 7, 2005. Besedina filed a lawsuit against the subway, the Metropolitan Transit Authority, (MTA), claiming two transit workers ignored her plight and refused to help her.

The Queens Supreme Court judge ruled that the transit workers had acted promptly by calling the command center to notify the police. The judge said there was no negligence from the workers but Besedina claimed they could have done more to prevent her ordeal.

Besedina claimed the token booth clerk and a conductor saw what was happening but they did not come to her aid. Besedina said her attacker held her over the tracks and sexually assaulted her. When police arrived 10 minutes later, he had escaped. Police do not have any suspects.

Besedina said she has suffered from anxiety since the rape. Maria Besedina wants to appeal against the Supreme Court’s ruling.
