Kelly Rutherford and David Giersch are divorcing and it has turned ugly. Rutherford has sought a court order barring Giersch from leaving the US with their son, Hermes Giersch, 2. Rutherford and Giersch both want custody of their son.

Giersch has alleged that Rutherford has a bad temper to discredit her. Giersch said Rutherford once threw a laptop at him. Giersch also accused Rutherford of trying to sock him with her fist. Giersch said Rutherford commutes from coast to coast because of her work on Gossip Girl.

Giersch described on Rutherford’s routine of work, beauty treatments and the like prevented her from spending time on her marriage. Giersch said Rutherford maintained her lifestyle because he was taking care of Hermes. Giersch said he wants his two children to have a stable family environment. Rutherford is expecting their second child.
