Kelly Lumadue, 32, will get a new trial on the old charges that she had sex with a boy, aged 5, 11 years old. The victim is now 16 years old and he can not recall the incident.

Kelly Lumadue went back to court on her new trial for having sex with the five year old boy, eleven years ago. Kelly Lumadue was convicted in 2007 of sexually battering the young boy. A judge threw out the conviction because of potential juror misconduct and an aggressive prosecutor. Kelly Lumadue has admitted having sex with the boy. When Kelly Lumadue was 21, she had sex with the boy, aged 5. Lumadue was charged after her sex tapes were found. Lumadue thought it was safe to discard her old sex tapes in the garbage but the refuse collector found them.

Kelly Lumadue was married to Leonard Lumadue in 1996. Leonard Lumadue was a professional pornographer who recorded the sex tapes between the boy and his wife, Kelly Lumadue. Leonard Lumadue has passed away. Kelly said in her defense that she was forced by her husband to perform the sex acts on the boy. A conviction would mean a compulsory life sentence for Kelly Lumadue. Testimony for this second trial for Kelly Lumadue started on Tuesday and ended this week. Kelly Lumadue was convicted a second time and found guilty. Lumadue will get life imprisonment. Lumadue will not have the option of parole.
