Gordon Weaver’s new trial on Jean Weaver conviction

Gordon Weaver was tried and convicted of second degree unintentional murder of his wife, Jean Weaver. Weaver’s trial in Nov 2005 found him guilty. Gordon Weaver was sentenced to 25 years in prison.

Weaver’s defense attorney argued that Jean Weaver died from hitting her head in a fall. Weaver’s prosecution argued that Jean Weaver died from smoke inhalation and that she was alive after the fall.

Gordon Weaver has been granted a new trial due to some controversies over the lab tests that the prosecution used. The date has not been set for Weaver’s new trial. The Constitutional protection against double jeopardy forbids the charging of Weaver in any charge more severe than the one he was first convicted of in his first trial. Briefly, Weaver can’t be convicted of any charge more severe than second degree unintentional murder.
