David Harold Earls raped and sodomized a girl, 4. Earls was the girl’s babysitter when he committed the crimes. Earls pleaded guilty in a plea deal. The judge sentenced Earls to 20 years but suspended 19 years. Earls will only be serving 1 year in prison and has to pay $1000 fine.

Earls was a twice convicted felon but the girl’s mother said she could not find his criminal past on the internet. She hired Earls to babysit her two children on weekends while she worked. Her son initially said he also engaged in sexual activity with his sister, along with Earls but the boy retracted his statements after being told the acts were wrong.

There is an ongoing controversy over the length of sentence imposed on David Earls.
