Chris Benitez, 24, was arrested on suspicion of starting a fire in the Southwest Supermarket on March 14, 2001. The fire in Phoenix killed a firefighter. Benitez was arrested on July 4, in Texas. Bret Tarver, a firefighter, was fighting the blaze at the back of the supermarket.

Tarver was trapped in the debris, became disorientated and lost consciousness. Other firefighters and rescuers managed to pull Tarver out of the burning building before it collapsed. Tarver’s autopsy revealed he died from his burns and smoke inhalation. Bret Tarver was survived by his wife and three young daughters.
