Brittany Noffke: Cheerleader Noffke has no lawsuit
By Therese Lisieux on January 27th, 2009Brittany Noffke was a cheerleader at Holmen High School, La Crosse, Wisconsin. In 2004, Noffke and her team of cheerleaders were practicing a stunt. Noffke was lifted to stand on the shoulders of another student. Noffke fell backwards and hit her head on the floor.
The student who lifted Noffke was supposed to be a spotter but he failed to catch her. There was no second spotter. Noffke’s family sued the student spotter and the school district. The high court in Wisconsin determined that the male cheerleader made a mistake by being out of place when Noffke fell. The court said he did not act recklessly and that meant there was no legal standard to permit a lawsuit to follow.
